These terms govern your use of thekrackofdawnart.com and any purchase you make from Krack of Dawn Art. Please read them before ordering — placing an order means you accept them.

1. Who we are

Krack of Dawn Art (“KODA”, “we”, “us”) is the studio of the artist DawnE, offering original soft pastel paintings, fine art prints, digital downloads and painting workshops. You can reach us any time at Krackofdawnart@gmail.com.

2. What we sell

Original paintings are one of a kind. Each is worked by hand in soft pastel and sold once only. Once a painting sells, it is gone.

Fine art prints are giclée reproductions on archival paper, produced in the size shown on the product page.

Digital downloads are high-resolution image files delivered electronically. Nothing physical is shipped.

Workshops are live sessions with limited seats. Registration details and any cancellation terms are shown on the workshop listing.

3. Prices and payment

All prices are in US dollars. Payment is processed securely by Stripe. We never see or store your card number — Stripe handles it directly. Applicable sales tax, if any, is calculated at checkout.

We may change prices at any time, but a change will never affect an order already placed and paid for.

4. Shipping

We ship within the United States only, and shipping is free. We do not ship internationally at this time. Orders are typically packed and dispatched within a few business days; originals are wrapped and protected individually because pastel is a delicate medium.

5. All sales are final

Because every original is unique and prints are produced individually, all sales are final. We do not accept returns or exchanges, and we do not offer refunds for change of mind.

We want you to buy with confidence, so please read the description, dimensions and medium carefully, and look closely at the images before ordering. If you have a question about a piece — its true colour, its scale, how it is finished — email us before you buy and we will answer honestly.

If your parcel arrives damaged, that is a different matter. Contact us within 7 days of delivery with photographs of the artwork and the packaging, and we will work with you and the carrier to put it right.

6. Digital downloads

Your download link is delivered by email as soon as payment clears. Because the file is available to you immediately, digital downloads are non-refundable.

When you buy a download you receive a personal-use licence. You may print the file for your own home, or as a gift for someone else. You may not resell it, redistribute it, share the file, use it commercially, or incorporate it into products for sale. Copyright remains with the artist at all times.

Printed results vary with paper, printer and screen calibration. We cannot guarantee that a home-printed file will match the colours you see on screen.

7. Colour and reproduction

Soft pastel has a depth and texture that photography flattens. We photograph every piece as faithfully as we can, but screens differ, and slight variation between the image and the artwork in your hands is normal and is not a defect.

8. Copyright

Every painting, photograph and piece of writing on this site is the property of DawnE and Krack of Dawn Art, and is protected by copyright. Buying an artwork transfers the physical object to you; it does not transfer copyright or reproduction rights. You may not reproduce, scan, print, publish or sell images of the work without written permission.

Images on this site are watermarked. Removing or obscuring a watermark is not permitted.

9. Your account and conduct

If you create an account, you are responsible for keeping your login details secure and for activity that happens under it. Please do not use this site to do anything unlawful, to interfere with its operation, or to attempt to access areas you have not been granted.

10. Limitation of liability

We take real care with our work and with your order. To the fullest extent permitted by law, our liability for any claim arising from your purchase is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Nothing in these terms limits any right you have that cannot be limited under applicable law.

11. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any dispute arising from them or from a purchase will be handled in the state or federal courts located in Tennessee, and you agree to that jurisdiction.

12. Changes to these terms

We may update these terms from time to time. The version published here, with the date at the top of this page, is the version that applies. Changes are not retroactive — the terms in force when you ordered are the terms that govern that order.
